Terms of Service
These terms govern the provision of plumbing services by SYD Plumbers (ABN [ABN_PLACEHOLDER], hereafter "SYD Plumbers", "we", "us", "our") to customers in the Sydney metropolitan area. By engaging us to perform plumbing work, you agree to these terms.
1. About us
SYD Plumbers is a NSW Fair Trading licensed plumbing contractor (L XXXXXX). All plumbing work is performed by appropriately licensed plumbers; gas work is performed by appropriately licensed gasfitters. We carry public liability insurance to $20M Public Liability Insurance.
2. Quotes
All quotes are provided in writing prior to commencement of work. Quotes are valid for 30 days from issue unless otherwise noted. Quotes for emergency work issued on-site are valid for the immediate engagement only.
For time-and-materials work, quoted figures represent our reasonable estimate of total cost based on the information available at quote time. Where actual scope expands during the work (e.g. additional damage discovered once walls are opened), we will pause work, notify you, and provide a written variation quote before continuing.
For fixed-price work, the quoted price is binding subject to the scope and conditions stated in the quote.
3. Pricing
Our standard pricing structure:
- Standard hourly rate for genuine emergencies any hour of any day, including weekends and public holidays
- Premium hourly rate applies only to non-urgent work specifically scheduled outside business hours
- Parts at supplier cost plus a flat 15% markup
- No separate call-out fees; travel and the first 30 minutes of on-site diagnosis are included in the hourly rate
- Time billed in 15-minute increments after the first 30 minutes
All prices are quoted inclusive of GST.
4. Payment
Payment is due on completion of work. Accepted methods:
- Credit card (Visa, Mastercard, AMEX)
- EFTPOS
- Bank transfer (cleared funds required for completion sign-off)
For jobs over $2,500, deposit and progress payments may be arranged in writing prior to commencement. We do not accept cash payments for jobs over $1,000 to maintain clean documentation for insurance and tax purposes.
Late payment may incur interest at the rate prescribed under the Civil Procedure Act 2005 (NSW). Accounts unpaid 30 days after invoice date may be referred to debt recovery.
5. Workmanship guarantee
We provide a 12-month workmanship guarantee on every install and repair, commencing on the date of work completion. If our work fails within this period due to defective workmanship, we will attend to remedy the issue at no charge.
The workmanship guarantee does not cover:
- Failures caused by misuse or unauthorised modification by the customer or third parties
- Failures caused by external factors not reasonably foreseeable at the time of installation (e.g. extreme weather events, building movement)
- Wear and tear of consumable components beyond their reasonable service life
- Failures caused by pre-existing conditions that were not part of the engaged scope of work
6. Manufacturer warranties
Manufacturer warranties on installed parts (e.g. Caroma fixtures, Rheem and Rinnai hot water units, Bosch appliances) are passed through directly to the customer. Warranty paperwork is provided on completion. Warranty claims for parts are made directly to the manufacturer; we will assist in coordinating warranty attendance where required.
7. Customer obligations
You agree to:
- Provide accurate information about the plumbing issue and property
- Provide reasonable access to the work area
- Disclose any known asbestos, hazardous materials, or unusual building conditions before work commences
- Provide power and water access as required for the work
- Authorise quoted scope before work proceeds
- Pay invoiced amounts when due
8. Cancellations
Scheduled non-emergency appointments cancelled with less than 4 hours notice may incur a cancellation fee equal to one hour of the applicable hourly rate. Emergency dispatches cancelled prior to plumber arrival are not charged. Where the plumber has already arrived on-site, a minimum 30-minute charge plus travel applies.
9. Limitation of liability
To the maximum extent permitted by Australian Consumer Law, our liability for any defective workmanship is limited to the cost of remediation of the defective work. We are not liable for consequential losses including loss of business, loss of rent, or loss of use beyond what is covered by our public liability insurance.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law.
10. Insurance documentation
Where work has been performed in response to an insurance event (e.g. burst pipe damage), we provide standard insurance documentation including itemised invoice, photographs of the failure point and damaged areas, and a written cause statement on letterhead at no additional charge.
Additional reports requested by your insurer beyond standard documentation may incur a fee, quoted in advance.
11. Compliance certificates
Where the work performed requires a NSW Certificate of Compliance (e.g. gas work, certain drainage work), the certificate is issued on completion and is included in the quoted price unless otherwise stated. Certificates are emailed within 48 hours of job completion.
12. Privacy
Personal information is handled in accordance with our Privacy Policy and the Australian Privacy Principles under the Privacy Act 1988.
13. Disputes
If a dispute arises, we encourage you to contact us first at info@sydplumbers.com so we can attempt to resolve the matter directly. If we cannot reach resolution, you may lodge a complaint with NSW Fair Trading (nswfairtrading.gov.au) or, for disputes under $40,000, the NSW Civil and Administrative Tribunal (NCAT).
14. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
15. Changes to terms
We may update these terms from time to time. The version in effect at the time you engage our services will apply to that engagement. The "last updated" date at the top of this page indicates when these terms were most recently revised.
